The database where your information is recorded is the responsibility of CRETIA, which is located in Mexico City, and your information is duly safeguarded in accordance with the provisions of administrative, technical, and physical security established in the applicable law, to protect it from possible damages, losses, alterations, or unauthorized access.

The Information Owner acknowledges and accepts that in case this “Privacy Notice” is available through a website (web page, internet page, or similar) or any other electronic device, by continuing to browse the site, or by providing your Data through it or through any electronic means (email, etc.), constitutes a manifestation of your consent for CRETIA to process your Data, in accordance with this Privacy Notice.

The personal data we will collect will be those that you have included in your profile of each social network you access and that is enabled in the application, and they will be treated and safeguarded based on the principles established in the Law and its Regulations. To fulfill the purposes mentioned in this Notice, we require you to provide us with the following Personal Data:

Real-time location, photograph, handwritten signature, Name(s), Mother's Last Name, Father's Last Name, CURP, Position in the organization, Phone Number, Email Address, Social Security Number, last login, username, and password.

Time zone, Name, Business Name, RFC, Health License, Billing Email, Logo, Address (Street, Number, Postal Code, Neighborhood, Municipality, City, State, Country), Digital Seal Certificate, documents in any format (pdf, excel, photographs, among others).

Clients

Name of the organization, Business Name, RFC, Phone, Address (Street, Number, Postal Code, Neighborhood, Municipality, City, State), documents in any format (pdf, excel, photographs, among others).

Client Facilities

Name of the organization, Name of the facility, Business Name, RFC, Phone, Address (Street, Number, Postal Code, Neighborhood, Municipality, City, State), documents in any format (pdf, excel, photographs, among others), facility areas, email, and basic contact data of the person in charge.

Suppliers

Name of the organization, Business Name, RFC, Phone, Address (Street, Number, Postal Code, Neighborhood, Municipality, City, State), documents in any format (pdf, excel, photographs, among others).

Employees of Clients and Suppliers

Name(s), Mother's Last Name, Father's Last Name, handwritten signature, department, position, photograph, phone number, email of the person in charge of the organization/facility, username, and password.

Sensitive Data

The Information Owner acknowledges and accepts that due to their relationship with CRETIA they have not provided, nor will they have to provide “sensitive personal data,” that is, those personal data that are intimate or whose due or undue handling may give rise to discrimination or involve a serious risk to them. In the event that the Information Owner provides sensitive data, they must agree to provide them beforehand and will hold CRETIA harmless from any respective complaint or claim.

Requests

The owner may exercise their rights of access, rectification, cancellation, or opposition regarding the personal data that concern them, as well as request the revocation of their consent, by sending a request to CRETIA through the website www.cretia.app to the email address [email protected] indicating at least their name and full address or any other data or document that allows their identification, as well as the purpose of their request and/or the procedure to be carried out. This must be done based on the Law and its Regulations.

Purpose

Your personal data and history as a client will be used by CRETIA or any of its subsidiaries and/or affiliates, and will be recorded in our database, as well as any other personal, sensitive, or other information, provided that the provisions of the Law and its Regulations regarding each type of information are met. This information may be used by CRETIA for any of the following purposes:

a. Commercial Purpose

(i) Name of the Information Owner, address, RFC, phone, billing account number, date of birth, banking data.

This information may be used, including but not limited to: (1) to offer you products and services, either physically, by phone, electronically, or by any other technology or means available to CRETIA; (2) to inform you about new products or services that may be of interest regarding the contracted service; (3) to automatically charge the billed amounts for your convenience; (4) to issue purchase orders or job requests, as applicable; and/or (5) any other action necessary to comply with CRETIA's interests regarding the agreement reached with the Information Owner.

b. Employment Purpose

(i) In relation to job offers or requests through the submission of resumes, information such as name, address, contact phone, email address, level of education, personal references, professional experience, RFC, social security number, CURP, official identification may be requested.

This information may be used, including but not limited to: (1) evaluation as a potential candidate to occupy a vacant position; (2) if applicable, the preparation of the Service Provision Contract and/or Individual Labor Contract; (3) to provide references in case another person or company requests them about candidates.

c. Security Purpose in Accessing Facilities

This information may be used, including but not limited to: (1) to back up, register, and/or control the log of people who access or visit CRETIA's facilities; (2) to comply with the security guidelines established in CRETIA's internal policies. In relation to the information requested for entry to CRETIA's facilities, information such as full name, signature, official identification, as well as information about electronic equipment to be brought into CRETIA's facilities may be requested.

Transfer

The Information Owner understands and accepts that CRETIA and/or any of its subsidiaries and/or affiliates may transfer their personal data to third parties that have been contracted by CRETIA to perform certain tasks on its behalf related to the commercial activities and promotion of its products and/or services. These third parties may process the data in compliance with CRETIA's instructions or make decisions regarding them as part of the provision of their services. In either case, CRETIA will select providers it considers trustworthy and who commit, through a contract or other applicable legal means, to implement the necessary security measures to ensure an adequate level of protection for your personal data. As a result, CRETIA will require its providers to comply with security measures that ensure the same levels of protection that CRETIA implements during the processing of its data as a CRETIA client. These selected third parties will have access to your information for the purpose of performing the tasks specified in the applicable service contract to which they have subscribed with CRETIA. If CRETIA determines that a provider is not complying with the agreed obligations, it will take immediate action.

If the owner does not accept the transfer of their personal data in accordance with the stipulations in the previous paragraph, they may contact CRETIA through any of the means established in this Privacy Notice.

Exceptions

Additionally, and in accordance with the stipulations in Articles 10, 37, and other relevant provisions of the Law and its Regulations, CRETIA will be exempt from the obligations regarding consent for the Processing and Transfer of your Data when:

It is provided for in a Law;

The data appears in publicly accessible sources;

The personal data are subject to a prior dissociation procedure;

It has the purpose of fulfilling obligations arising from a legal relationship between the owner and the responsible party;

An emergency situation exists that may potentially harm an individual in their person or property;

They are indispensable for medical attention, prevention, diagnosis, the provision of health care, medical treatments, or the management of health services;

An order from a competent authority is issued;

When the transfer is necessary for the recognition, exercise, or defense of a right in legal proceedings, and

When the transfer is necessary for the maintenance or fulfillment of a legal relationship between the responsible party and the owner.

Modifications

If any modification to the provisions established in this Privacy Notice is required, CRETIA is obliged to inform of any changes that may be necessary, by any means, including electronic ones, prior notice to you so that you may express your opinion on what is in your best interest, as not receiving an express written denial from you, or any response, will be understood as acceptance of the changes made.

The Information Owner acknowledges and accepts that in case this “Privacy Notice” is available through a website (web page, internet page, or similar) or any other electronic device, by clicking “accept” or in any other way continuing to browse the site, or by providing their Data through it or through any electronic means (email, etc.), constitutes a manifestation of their consent for CRETIA to process their Data, in accordance with this Privacy Notice.
